This Acceptable Use Policy (“AUP”) governs your use of The Valley List, LLC (“TVL,” “we,” “us”) website and any services we provide (the “Services”). You agree to use the Services only for lawful commercial or professional purposes and in compliance with this AUP, our Terms & Conditions, and all applicable laws and regulations.
TVL may modify, change, or discontinue any aspect of the Services at any time, including pricing and fees.
Time Zone and How We Measure Time
Unless otherwise stated:
- All times are based on Eastern Time (ET).
- Billing and enforcement timelines are measured in calendar days.
- Support response targets are measured in business days.
If a timeframe is stated in one place as “days” and in another as “business days,” the more specific definition controls.
Relationship to Other Terms
This AUP is incorporated into TVL’s Terms & Conditions and any applicable service agreement. If there is a conflict, the order of precedence is:
- A signed proposal/contract or written agreement, then
- Terms & Conditions, then
- this AUP, then
- other published policies, unless stated otherwise in writing.
1) Prohibited Use
You may not use the Services in any way that TVL, in its discretion, determines to be illegal, harmful, abusive, or that interferes with other customers or TVL infrastructure. Prohibited use includes, without limitation, any use that:
- Is illegal or promotes/encourages illegal activity
- Involves child sexual abuse material (CSAM), child exploitation, or child pornography
- Promotes, encourages, or engages in terrorism or violence against people, animals, or property
- Promotes, encourages, or engages in spam, unsolicited bulk messaging, or abusive outreach
- Promotes, encourages, or engages in hacking, cracking, credential stuffing, malware distribution, or unauthorized access attempts
- Promotes, encourages, or engages in the sale or distribution of prescription medication without a valid prescription
- Infringes the intellectual property rights of any person or entity
- Violates privacy or publicity rights, or breaches confidentiality obligations
- Interferes with the operation of the website, Services, systems, or networks
- Contains or installs malware or harmful code (including viruses, worms, trojans, cryptominers, or code intended to disrupt, damage, degrade performance, or exfiltrate data)
- Contains false or deceptive statements or unsubstantiated/comparative claims about TVL or TVL services
Data Harvesting and Privacy
You may not collect, harvest, scrape, or store non-public or personally identifiable information about any person without their express prior written consent.
2) Excessive Use of Resources / Network Abuse
You may not consume excessive server or network resources or use the Services in any way that results in performance issues or service interruptions for other customers.
Examples of prohibited activity include, without limitation:
- Hosting or linking to anonymous proxy services
- Operating file-sharing services
- Running scripts or processes that degrade performance or stability
- Using software that interfaces with Internet Relay Chat (IRC) networks in a way that impacts infrastructure
- Hosting plugins, scripts, or processes that are harmful, resource-intensive, or otherwise adversely impact TVL systems
If your usage affects stability, TVL may require you to reduce usage, remove offending software/content, upgrade services, or suspend/terminate Services to protect the network and other customers.
3) Unauthorized System Access and Automated Access
You may not use the Services to gain access to any network or system without permission, including, without limitation:
- Probing/scanning for vulnerabilities
- Attempting to bypass authentication or security measures
- Attacking networks (including DoS/DDoS attempts or use of botnets)
- Intercepting or monitoring data without permission
You may not use automated tools to access or collect information from TVL systems for unauthorized purposes, including, without limitation, scraping, crawling, indexing, spiders, offline readers, click-spam tools, macros, or similar automation.
4) Storage of Backups
Hosting accounts are intended to host your website and related files. You may not use TVL hosting primarily as a backup repository or storage vault.
TVL may remove unusually large or excessive backup archives from hosting accounts, with or without notice, to protect system stability.
5) Content and Intellectual Property
5.1 User Content
Certain Services may allow you to post, publish, upload, store, or manage content such as text, images, video, or other materials (“User Content”). User Content includes all content submitted through your account.
5.2 Your Responsibility
You represent and warrant that:
- You have all rights, licenses, consents, and permissions required to submit and use User Content through the Services, and
- Your User Content does not violate any third-party rights
You are solely responsible for your User Content and any consequences arising from it (including claims, damages, or legal obligations).
5.3 Security Features
You may not circumvent, disable, or interfere with security-related features of the Services, including features that restrict copying or access.
6) No Resale Without Permission
You may not resell, white-label, or provide the Services (or related technologies) to third parties for commercial purposes without TVL’s express prior written consent.
7) Identity Verification and Call Recording
TVL may request government-issued photo identification and/or business identification for identity verification when reasonably necessary (for example, to prevent fraud or verify account ownership).
TVL may record calls where permitted by law. Where required, you will be informed of the recording.
8) Enforcement
TVL generally does not pre-screen content hosted on client websites. However, TVL reserves the right (but does not assume a duty) to review content and determine whether use or content violates this AUP or other policies.
TVL may, at any time and where permitted by law:
- Remove or disable access to content
- Suspend or terminate Services
- Restrict access or lock accounts/services
- Remove data or files stored on TVL systems where necessary to protect systems, comply with the law, or prevent abuse
TVL may immediately suspend or terminate Services for severe violations, including CSAM/child exploitation, terrorism-related activity, repeated abuse, or activity that threatens the security or stability of TVL systems or other customers.
9) No Spam Policy
TVL does not tolerate spam. We monitor traffic to and from our systems for indications of spam and abuse.
Definition of Spam
Spam includes Unsolicited Commercial Email (UCE), Unsolicited Bulk Email (UBE), or unsolicited marketing messages sent without confirmed consent, including via email, SMS/text, forums/comments, chat/instant messaging, pop-ups/adware/spyware messages, or fax solicitations.
Commercial advertising and/or bulk messaging may only be sent to recipients who have opted in and must include:
- A legitimate sender identity
- A valid physical address (where required)
- A working opt-out mechanism
TVL may request proof of opt-in at any time.
Enforcement
If TVL determines that Services are being used for spam, TVL may suspend, redirect, or cancel the affected Services until the customer demonstrates that the abuse has stopped. Repeat violations may result in termination.
